BEWARE! (Read before this happens to you) 9/29/2022
After losing our mother as a result of medical malpractice, we were advised to seek legal counsel. We heard about Lubin & Meyer from a friend and decided to contact them. After meeting with Ben Novotny, a partner in the firm, and providing him with all the necessary medical records he needed, we were told they were taking our case. The Contingent Agreement was signed on September 11, 2017, five years ago.
The last time we met with Ben Novotny was December 5, 2018. At this meeting he informed us that we will not be hearing from the firm for quite a while, as they will be building the case. He promised us that he would treat our mother's case with great care and we shouldn't worry about anything. Shortly after that meeting, we were informed that Ben left the firm, which was very upsetting as we felt comfortable with him and he seemed to care about our mother. We were told that our new contact person was Karen Zahka, a firm Associate, who I never ended up meeting. September 5, 2019, we received a letter from Andrew Meyer informing us that Karen Zahka has resigned. We were given options of who we could now have represent us. Given that we were with Lubin & Meyer for two years already, we stayed with them and now had our THIRD ATTORNEY, a Partner by the name of Krysia Syska. Needless to say, we now were feeling like our mother's case was just being tossed around and there was no one who cared about her, who was invested in her case.
Over the next couple of years our depositions were taken, and COVID happened, which needless to say, slowed the court system way down.
On November 12, 2021, I received a letter from Krysia Syska stating that a trial date had been set for October 3, 2022. She stated that she will contact me to arrange an appointment for preparation for trial. I called two weeks before the trial date, as instructed by Krysia, and I was told that my siblings and I were going to be scheduled for the preparation for trial appointment as soon as it is decided who would try our mother's case, as Krysia does not try cases any longer. Attorney Syska never reached out to me herself to explain any of this. This was not only unprofessional, but extremely disrespectful. So now, a FOURTH ATTORNEY, William Thompson, who knew absolutely nothing about our mother's case before last week, was who my siblings and I were meeting with on September 28, 2022, to "supposedly" prepare for the trial, which was starting in five days.
PLEASE PAY ATTENTION TO THIS
Instead of preparing us for the trial that Lubin & Meyer has been building a case on for FIVE YEARS, Mr. Thompson started telling us that we have virtually no chance of winning this case. He stated that there was not enough convincing evidence, but if we wanted to go on with the trial, he would try the case, he was leaving it was up to us. THEY HAD THE EVIDENCE FOR FIVE YEARS!!! They lead us on for FIVE YEARS, never once telling us that there was not enough convincing evidence or that the case was weak. We trusted them with our mother's case. Now, five days before the trial, with, as Mr. Thompson stated, "No settlement offer from the defendant's insurance companies", he was trying to get Lubin & Meyer out of having to try the case. We felt we had no choice but to drop the case as we had no faith or trust left in this firm.
IT WAS SIMPLY ALL A LIE.
WE WERE SCAMMED FOR FIVE YEARS.
LUBIN & MEYER ONLY FOLLOWS THROUGH IF IT'S A SURE THING.
Now it is too late for us to seek the justice and accountability our mother deserves. Our family is sickened by their deceitful actions. We feel as though our mother's life has been disparaged by Lubin & Meyer.
